BULGINGBRAIN Terms of Service

Bulgingbrain is an independent contractor and neither bulgingbrain nor staff is or shall are deemed to be employed by Client.
Response time. Bulgingbrain will do it’s best to respond within a reasonable amount of time to each service call. On-site response time varies on a daily bases and can fluctuate between right away, 3hrs, to 48hrs depending on current work load and nature of call.
Liability. BULGINGBRAIN is not liable for the following: faulty wiring, system not installed by Bulgingbrain, software malfunctions, loss of data not backed up, third party computers not built or designed by Bulgingbrain (examples: DELL, SONY, HP, and all third party systems all ordered by third party companies come with their own warranty), power outages, loss of power, user intervention, user mishandling, all acts of god. Neither party shall be liable to the other for any lost profits or indirect or consequential damages arising under this Agreement or any Statement of Work. In no event shall Service Provider (bulgingbrain) be held liable for direct, indirect, special, incidental or consequential damages arising out of service provided hereunder, including but not limited to loss of profits or revenue, loss of use of equipment, lost data, costs of substitute equipment, or all other costs.
Assignment and Subcontracting. Client cannot assign this agreement or any statement of work or subcontract any work required to be performed by it without the prior written consent of bulgingbrain.
Termination. Either party under the terms of this agreement may terminate the Service Level Agreement at anytime with a thirty day notice. All service fees must be paid in full to bulgingbrain prior to cancellation of contract by client. After all fees have been paid to bulgingbrain, any and all passwords and/or network info will be supplied in an email to the appropriate person for said client.
